capital gain sa pagbili ng lupa

ang father ko po ay may biniling lupa maraming taon na ang nakakalipas
naipagbayad naman po ng tinatawag na capita gain, sa bir po nagbayad

subalit hindi pala naiparegister sa register of deeds
ngayon ko lang po nadiscover na hindi pala naiparegister

so may nilapitan kaming tao parang syang mag ayos
at ang sabi ay hindi nga raw po nairegister
KUNG KAYAT DAPAT AY MULING MAGBAYAD SA BIR

kasi bayad na po ng capital gain un
dapat po bang ipagbayad muli kasi parang expired na raw po ung naunang payment na hindi nga nairegister sa register of deeds

^ May kopya ka ba na dokumento na tinanggap ng BIR ang bayad sa capital gains tax?

Kung wala, pwede ka ba makahingi ng certification sa BIR at clearance na ikaw or ang tatay mo ay bayad na sa capital gains tax?

Kung ayaw ng BIR magbigay ng certification or clearance, kailangan mo uli magbayad ng capital gains tax.

Dapat documented ng BIR yung first payment ng cap gains tax...if u don't have any document for that payment, you have to pay again...as a rule, any money transaction with any govt agency should be documented.

my officemate is buying a 120sqm lot @ 4.5K/sqm. below are the total transfer fees. she needs advise kung tama lang ito? the lot is in a subdivision in davao city. (i just added the percentile)

processing fee   10,000   1.85%
witholding tax     74,000   13.70%
doc stamp           8,100   1.50%
property tax         6,000   1.11%
entry fee           11,666   2.16%
transfer tax          4,320   0.80%
notarization        27,000   5.00%

Normally as a buyer, you only pay for the transfer tax (0.5%), documentary stamp tax (1.5%), registration fee (around 0.6%) and other expenses related to the transfer (around 0.8%).  Is your officemate directly dealing with the registry of deeds?  Or did he/she hire an agent to process the transfer?  I'm wondering what those other fees are, like processing fee, withholding tax, notarization.  Property tax is normally paid by the seller.  Entry fee is to high, should be only around 30 pesos.

^ property tax ---- baka hindi up-to-date bayad ng old owner sa real estate tax kaya kailangan bayaran para malipat ang ownership

withholding tax ---- there is no such tax for a purchase of property

notarization fee ---- too much for a gross sales value of 4,500 x 120 sq.m. or about 540,000 pesos. 

I think something smells fishy in this transaction.  malinaw may kumita ng illegal.

Ang napag usapan nila is, ang seller ang mag process magbayad na lang daw ng mga above-mentioned. Gustong-gusto pa naman nya sana ang lote pero baka mag-withdraw na lang daw sya.

mare-reduce pa kaya ang fees kung sya mismo mag-process ng transfer? or world-class na talaga ang sitwasyon. hehe

First things first.  Ayusin muna ang  Deed of Absolute Sale.  You may want to consult a lawyer para malinaw ang usapan.  Ilagay ang detalye ng mga babayaran at kung sino ang magbabayad, whether seller or buyer.  Always apply the "Caveat Emptor" principle when buying properties.

Normally, eto ang mga binabayaran na fees para makumpleto ang pag-transfer ng property from seller to buyer:

1.   Deed of Sale notarial fee (I think around 1% or less) - paid to Notary Public
2.   Capital Gains Tax (6%) - paid to BIR
3.   Documentary Stamp Tax  (1.5%) - paid to BIR
4.   Certificate Authorizing Registration Certification Fee (around 100 pesos) - paid to BIR
5.   Outstanding Real Property Tax (depends on the assessed value of the property) -  paid to Davao City hall 
6.   Transfer Tax (0.5%) - paid to Davao City hall
7.   Registration fees and other charges (around 1.5%) - paid to Land Registration Authority - Registry of Deeds
8.   Processing fees (around 50 pesos each) to secure the following documents from Davao City hall:
      a.  Certificate of no improvement
      b.  Certified true copy of tax declaration
      c.  Tax clearance

Also check if the property owner has outstanding subdivision association dues and agree on who pays for it.  Pwede na rin yan isama sa deed of sale. 

After the transfer of title, the new owner must register a new tax declaration under his/her name from Davao City hall.  Processing fee is I think 50 pesos or even less.

See if you have a copy of BIR Certificate Authorizing Registration (CAR). If it is still with you, proceed to ROD/LRA to process the transfer of title. Don't ask others (fixers) to do the work, they will only extort money from you.

Otherwise, if you have no proof of BIR CAR, go to BIR and ask to reassess how much capital gains tax you have to pay since it will be coupled with interest and other penalties.
