Income Tax Questions

Question lang po: i have been working for years now but i don't pay taxes coz my office and the Gov't has this "Host Agreement" that officials/staff from our office shall be exempt from taxation in respect of the salaries and emoluments paid to us. But sometimes, this causes me some problem because i never had a Tax Identification No. and sometimes it is a requirement in purchasing cars, house & lot, even credit card applications require a TIN. But even if I do have one, i don't think it will serve its purpose since i am not filing anything to the BIR. Can someone be kind enough to explain to me these things. Thanks in advance.  :thankyou:

meron bang exemption sa pag file ng TAX if ang income is mababa lng talaga?

im not sure kung eto pa din yung system natin dyan ha.

ang alam ko is annual income P60k yata you dont have to pay tax pero you still have to file ITR

kung purely compensation income earner ka from only 1 employer ... yung certificate na ibibigay syo ng employer mo is already considered your ITR thus no need to file for a separate return

If your company is withholding the amount corresponding to your tax, then your company is not remitting any amount to the BIR since a TIN is required before you can pay your taxes.  I doubt if there's any such agreement between your company and the BIR which exempts you from paying income taxes.  Only those who are earning P60,000 annual income or below are exempt from paying income tax.

Hi jinryll71 and dream_rich
What i have with me a "Statement of Earnings for the Calendar Year" provided by my company. That is the document i present to anybody who would require me a TIN to explain why i don't have any. Yes, there is a Host Agreement between our company and the Government, It is actually under the National Internal Revenue Code of the Philippines, Republic Act 8424. I tried to file my ITR personally showing to the BIR the statement provided by my office but the BIR District Officer says they no longer accept returns from our office because of the Host Agreement (Section 22, Art. VIII). What i would want to know is if it would cause me problems later on when i would want to purchase a house or a car or anything that would require a TIN or an income/earning-check.

twinkle, fyi, jinryll71 was replying to arts24. Their posts were split from another thread and we've merged this into one thread on Income Tax Questions.

Have you tried asking your officemates? Maybe some of them have tried availing of a bank loan or applying for a travel document.

as advised by my a friend, pag hinanapan ako ng income statement or ITR by
financial firms, i can present any or all of the following:

1) Salary Statement
2) Certified True Copy of Statement of Earnings
   (including overtime pay, allowances, etc. issued by the company from the time na hindi
   ako nag-file ng ITR).
3) Copy of the Host Agreement signed by the BIR Commissioner.

whatever kumpanya naman daw ang magquestion nyan, they can always verify
sa BIR. And most financial firms aware naman daw that there are employees
na exempt from taxation in terms of salaries na nare-receive nila. siguro pag nagka business or sideline ako, un na lang ang kukunan ko ng TIN as additional docu.

to be honest, d pa ako nakapag file nang Annual ITR simula ng nag employed ako.. dahil sa new exemption ng bir sa monthly salary level but sadly at the end of the year the total gross income mo subject parin sa pag file.

Description
This return is filed annually by the following for business income derived during the calendar year regardless of amount of gross income:

b.  A resident alien, non-resident citizen or non-resident alien individual engaged in trade, business or practice of profession within the Philippines.  
c.  A trustee of a trust, guardian of a minor, executor/administrator of an estate or any person acting in any fiduciary capacity for any person, where such trust, estate, minor or person is engaged in trade or business.  

This is also filed by individuals who receive mixed income (compensation with self-employment/professional income).  

However, an individual whose sole income has been subjected to final withholding tax pursuant to Sec. 57(A) of the Tax Code, or who is exempt from income tax pursuant to the Tax Code and other laws, is not required to file an income tax return.  






Medyo kakalito rin kasi minsan pag nag apply ka ng Loan kasama sa requirements ang ITR.


ask mo na lang yung bank kung ano ang additional requirements kung OFW. baka they will ask you for a POEA certification  :D




Dati kasi trabaho ng company ko ang magwithhold ng Tax sa sahod nung nasa pinas pa.  Pag nag issue na sila ng W-2 noon, saka lang ako nagpafile ng ITR.


mas madali ngayon kse hindi na kelangang mag-file pa ng ITR kapag purely compensation income. yung W-2 / BIR 2316 na yung pinaka-ITR  :D

hindi po.. regular employee po ako ng isang company..
