A friend needs payo: Tenant left unit without paying rent

i am not sure if angkop itong question ko sa forum na ito, pero bahala na,ang alam ko all about money ang forum ,so try ko:
kaibigan ko po ang may problema

may bahay po sila na pinaupahan
ung umupa po ay dalawang buwan hindi nagbayad ng renta, bukod pa un ilaw at tubig na ndi rin nabayaran
tapos bigla na lang pong umalis ng walang paalam

ang alam po kasi namin ang utang ndi naman pwedeng ipakulong gawa ng utang
pero in this case, sabihin nating may utang syang dalwang buwang renta, pero ndi sya man lang nagpaalam at may utang syang bill sa tubig at ilaw, makakasuhan po kaya kapag ganyan, ano kayang kaso, estafa?

From what I have learned so far is that you may file a case for small claims. Civil case lang yata based on your description and not estafa. Di ba normally merong deposit at 2 months advanced payment? If maaari nga meron pdc para kahit panu meron konting security sa part ng owner.

Nangyare na din sa akin yan.. ubos na ang deposit. kaya ginawa namin pinabaranggay nalang. Mas malaki laban mo kapag may Contract ka at Resibo :)

Kung may agreement kayo na nakasulat o isang formal contract, may laban ang kaso mo pero depende pa rin yan kung ano nakasulat sa kasunduan nyo.  Sa barangay ka muna makipagusap tungkol sa kaso mo bago iakyat sa korte.  Medyo ma-abala ang magsampa ng kaso pero dapat gawin para hindi makaulit ang mga abusado at balasubas..

nangyari na din ito sa akin recently. condo tenant ko. manager pa din naman. biglang naglaho lang. di na namin macontact. pag bakasyon namin galing abroad, binisita namin yung unit, nilagyan pa ng padlock yung door ng condo, buti nabuksan ng isa sa mga "master" key ko. bukod sa hindi nagbabayad ng rent may bills pang iniwan more than 20t. hindi na rin kami naghabol. sana lang buhay pa sya. wala na kasi kaming balita. wala na rin syang valuable na mga gamit naiwan sa condo namin. wala din kasi kaming formal na contract. verbal lang bilang kaibigan. trust lang. ayun! lugi negosyo :) may iniwan naman syang lesson sa amin na hindi namin dapat kalimutan sa mga susunod na dealings namin.

sa case ng friend mo, may contact pa ba kayo sa tenant? kausapin nyo na lang muna yung tenant huwag agad mag file ng kung anu anong kaso :)

Dapat laging may written contract sa mga dealings gaya nito (kahit na kaibigan mo pa ang tenant mo).
Dapat may regular communication ka sa yong tenant.
Dapat mahigpit sa terms and conditions (wala kami nito, kasi nga kaibigan, akalain mo bang layasan ka).

Dapat black & white talaga.

Mahirap talaga pag-PERA na ang pinag-uusapan kahit kaibigan pa.

But actually, sila ang nawalan at hindi ikaw.
You've been building Trust and Hospitality with them.

Only civil aspect can be afforded to the owner through small claims. In the future, better rent out only to those who are employed to whom you can serve demand letters for non-payment of rent as additional evidence of demand. Also put the terms of rent in writing signed and notarized.

Actually maski naka black and white or rainbow colors pa, pag ayaw magbayad or walang oang bayad, what can you do?

File a case? Ok siguro if you are going after at least 150,000.00 Otherwise, sa legal fees, time and effort mo, ewan ko lang. Even then baka wala pa rin mangyari.

Actually be grateful na umalis yung tenant. Eh kung he stayed longer without paying?
Be more careful with your next tenant nalang.

And eto ang tip ko sa yo in case you like to go legal on these balasubas tenants.
DEMAND post dated checks (PDCs) to cover the duration of the lease contract.
While a person may not be jailed for nonpayment of obligations, there is criminal liability for bouncing checks.

Note that this is good only for the current contract. If the tenant is good for his PDCs but then not pay for his stay beyond the current contract ... GRRR.
