Kapitbahay na nagtayo ng apartment na lampas sa boundary...

Good morning po mga PMTers. Tungkol ito sa kapitbahay ko na nagtayo ng apartment lampas sa boundary. Yung apartment niya ay nakausli sa harapan ng lote niya, lampas na sa limitasyon, mga 1 meter lampas, hanggang sa daanan ng tao. Saan ko ba dapat ireklamo mga ganito? Salamat po.

Pag ganyan ata sa barangay muna.

pero consult ka na dn sa abugado kung pwede.dahil:
may permit kasi dapat nung tinayo. di dapat nakapagpatayo nang lampas. kung nagawa niya, pwedeng nilabag yung permit or nabigyan ng permit kahit ganun. kung nabigyan, may under the table siguro.

Sana mas makasagot yung mga expert dito.

Go to barangay so that there is a mediator. Make sure you have your plan or survey of your plot. They should also bring their documents and let the barangay sort it out.

This is a very technical issue and should be resolved easily well.

when you say lampas sa boundary, i believe you meant na lampas sa property line nung nagpa gawa ng apartment. meron ka bang pruweba?

at yung sabi mong lampas ng isang metro hanggang sa daanan ng tao, ibig mo bang sabihin ay sa kalsada?

if it's not going over your line of property then go to the barangay,

if it is going over your line of property then talk to a lawyer first :D

Salamat po sa mga replies. Meron po bang nilalabag na batas ang ganitong kaso tulad sa kapitbahay ko? Baka may nakakaalam po dito.

pulubing_palaboy...Yes hanggang sa kalsada para sa daanan ng tao. Pero hindi naman doon tumatakbo mga sasakyan. Kung property line, hindi ko alam kung nakasaad yon sa titulo. Pero lahat kaming mga kapitbahay ay pare-pareho, yun lang ang nagtayo na nakausli hanggang sa daanan ng tao.

Salamat po sa mga replies. Meron po bang nilalabag na batas ang ganitong kaso tulad sa kapitbahay ko? Baka may nakakaalam po dito.
 

I think meron paglabag sa batas. buy a Philippine building code at national bookstore. nakalagay sa building code ang tamang clearance even if it is inside the property line ng kapitbahay mo.

file a complaint with the city engineers office directly and they will check your neighbors construction work for possible violation of the building code.

for educational purposes,

hindi porke't ikaw ang may ari ng sarili mong lupa at lahat ng ipatayo mo sa loob ng property line mo ay pwede mo gawin.  your building must comply with the building code, otherwise the government has the right to order the demolition at your own cost.

within your own property line, you needed a clearance (front, rear, and side).

bauer is correct; however, for this particular issue, the property line has yet to be established. the said walkway might even be part of the property and all construction is within code!

Subdivision ba ito o baranggay?

Kasi kung sa subdivision, hindi na pinapansin yan kahit kainin mo un daanan ng tao kahit gawin mo na Garden.. pero kung exclusive sympre bawal :)

Subdivision ang property, hindi exclusive, pero nasa main road na daanan ng maraming mga sasakyan ng iba-ibang subdivisions at baranggays. Katabi ito ng property ko. As of now out of country kase ako. Siguro sa Munisipyo magtatanong ako tungkol dito. Salamat po.

^ File a complaint to the city or municipal engineer's office that has jurisdiction in your area.  No need to ask them if you have the right or if they violate the property limitation.  The way you told the story, I see a violation in the building code.

If you are based overseas, ask somebody living in your place to represent you.
