Buying a lot

Hi All,

I was offered a lot and am planning to purchase it through Pag-ibig. Ang problema is nasa Japan yung may-ari and he just wants to use an authorization with the power of attorney para malakad yung transaction without him going home here. Tanong ko lang kung pano yung magiging processs nito and kung possible ba.

Tanong ko lang kung pano yung magiging processs nito and kung possible ba.
May na-experience na kaming related sa ganyang kaso (nasa Japan naman yung buyer, not the seller). Tingin ko posible, Sir. Kaso inconvenient nga lang. (Dadaan pa yata sa consul sa Japan)

Less inconvenience kung nasa Pilipinas lang yung titulo para mas mapabilis ang proseso.

Hintay ka lang dito, may iba pang mas nakakaalam. Konsulta ka na rin sa agent or abugado para marami ka idea. Yung mga ganitong transaksyon ay mas mainam gawin or itanong ng personal.

Ive done this before [Im OFW Japan]


advice mo lang yong owner na nandito sa Japan na gumawa ng Power of Attornet then pa solomnize nya sa Phil. Embassy then send the document sa Pilipinas puede na yon gamitin to do the transaction . I advice at least 2 or 3 Original Copies of SPA .. meron kasi agency sa pinas na nag rerequire isubmit ang original na SPA para meron kayo spare (ayaw ng copy or certified copy for unknown reason)

Thanks thermometer. May question din po pala ako, tingin mo mas ok ba yung magpa-SPA na lang? Uuwi din kasi yung may-ari this month pero saglit lang sya. Eh diba it takes about three months bago ma-process lahat sa Pag-ibig? So iniisip ko kung SPA na lang ang gamitin para less hassle sa amin pareho. Tingin mo po?

Kung uuwi naman sya sa Pinas edi sa pinas nalang sya mag pa SPA.. kakailanganin nya tlaga ng SPA kasi mahaba ang processo ng pag aayos sa lupa... dito sa japan mahal ang mag pa SPA.. sa pinas mura lang
3 months hnde nman gurantee na matatapos agad sa pag ibig.. mas maige magkaron nalang ng SPA

pa-epal ako saglit....

SPA gagamitin lang sa transaction ng Deed of Absolute Sale kung hindi sya makakapipirma ng personal sa dokumento.

Kung uuwi sya at sya na ang pipirma sa Deed of Absolute Sale, di na kailangan ang SPA unless meron pa ibang dokumento na kailangan after ng purchase agreement ninyo at wala na sya sa Pinas.

Bago sya dumating sa pilipinas, check mo na lang lahat na clear ang Certificate of Land Title (CLT) or yung Transfer of Certificate of Title (TCT) ng lupa. Kung ito ay naka-mortgage o naka-prenda sa isang sangla, dapat ma-release muna.

Request ka na rin ng Certified copy ng TCT sa Register of Deeds (RD) kasi kahit na meron ka kopya ng original na TCT, hinihingi pa rin yung certified copy ng TCT from RD sa BIR o ano mang government agency. hindi ko alam kung bakit kailangan pa ng certified copy eh hawak mo na yung original.. (siguro tulad ng sa NSO na kailangan mo lagi ng galing sa kanila, at na-eexpire yung dokument.. :hihi:)

Kung minsan, kailangan din ng Certificate of No Improvement galing munisipyo lalo na kung dating classified na agri-land.

Hinahanap din minsan ang relocation survey ng lote galing Geodetic Engineer.

inquire ka na din kung saan ang mga sangay ng gobyerno ka pumunta at yung location nila .. yan ay kung ikaw mag-process.. pwede mo naman ipalakad na lang sa abogado or yung mga nag-aayos (fixer), syempre at a fee sa services nila.

eto po yung pwede ilakad habang nasa Japan yung may-ari ng lupa:

Municipal Assessor's Office - check kung updated yung tax payment; certificate of no improvement; tax declaration ng property
Register of Deeds - certified true copy of TCT
BIR - Tax Identification Number (TIN) nyo pareho - seller at buyer para sa BIR processing at payment ng mga taxes.

paano po malalaman na "Clean Title" yung property?

meron din na advice sa akin ang isang contractor dati, pag bibili daw ako ng lupa, ipa "relocate" ko daw yung lupa, tama ba yung term?  para masiguro daw na yung lupang pinakita sa amin at yung nasa titulo ay iisa at kung tama yung sukat ng lupa.

meron daw kasi sya dati experience na meron katabing pader na yung lupa na bibilhin sana nya at kinain ng pader yung property so hindi na accurate yung size ng lupa.

sa pagkakaalam ko, 'Clean Title' yung titulo ng lupa kung:

1. walang utang na buwis (updated tax payment in declaration)
2. hindi kasalukuyang naka-utang o nakasangla or released sya sa anumang mga mortgage dati.
3. walang kaso sa korte or 'pending court order'
4. walang naka-encroach na ibang property sa loob ng lote ayun sa 'relocation survey' na ginawa ng licensed Geodetic Engineer.
5. makakauha ka ng 'certified true copy' ng CLT or TCT sa Resgister of Deeds (RD).
6. kung agri land at irrigated ng National Irrigation Administration (NIA) ang lupa, dapat wala din utang sa patubig o updated ang payment.

regarding restriction ng lote, depende na siguro sa lugar lalo na kung loob ng subdivision ang lote at yung developer ay naglagay ng madaming restriction.

sir papaano po ba magpagawa ng relocation survey? may potential buyer na kasi ang lupa namin and nirerequest nya na ipa survey ulit namin ang lupa bago nya bilhin, willing yun buyer na sya na ang magpaalis sa mga squatters as long as ma survey  yun lupa bago nya bayaran. any advise po kung ano ang magandang gawin? kami po ba bilang may ari ang magaayos ng security mga surveyor or bahala na sila makipagcoordinate sa barangay or munisipyo?

Ang alam ko. mag-hire ka ng Geodetic Engineer para gumawa nung survey. Regarding security, tingin mas maganda kung kasama kang makipag-coordinate para mabenta nyo ung lupa.

Peolple would say price of lot will appreciate in long term, so this is a good investment.
So this is a good appreciating asset but it depends on many factors such as location, potential development in the area, road accesibility and so on, of course clean title.

But remember your money also depreciate over time, there is such a thing as inflation.

Let say you buy a lot for 1k per sqm now then after 10 yrs fair market value of your lot becomes 1,500 per sqm so its price appreciated, but remember buying power of your money is different compare 10 yrs ago.

Its ok to buy lot if you intend to use it for a purpose, building a house or anything that can be a source of income.

But if the idea of buying a lot is for investment purposes hoping it will appreciate its value i dont think its a good idea. Lot of factors involve in realty property investment.
