Help. Property paid SPOT CASH but with issues

I bought a House and Lot po sa isang subdivision from a Developer and I paid it SPOT CASH po. Bare type lang po yung house then pinagawa ko na po loob. Until now po Official Receipt lang hawak ko. My friend po who's working in Camella told me that dapat daw within 3 days mabigay ang TITLE pag lumagpas daw po dun pwede na kasuhan. Ang nangyare po sakin June 2012 ko pa nabayaran up to now resibo lang nabigay nila.

Then the problem came up. Ang sabe po ng Manager nila may nauna na daw pong nakakuha ng unit na to and he paid a "little amount" already through PAG-IBIG pero sabi nila nag-backout na daw po yung nauna. Yun daw ang reason why di pa maasikaso ang Title. As in OR lang po hawak ko until now. Now they are offering us a new unit with a clean and ready title na daw po at sila na bahala gumastos sa pagpapagawa ng loob kasi nga po gumastos na ako ng malaki. May times pa na pinapapirma ako ng agent nila ng blank forms. CTS at DOAS po na diko naman pinirmahan kasi alam ko po bawal yun.

Di ko lang po matanggap na binentahan nila ako ng gantong unit na may problem. Tanong ko lang po DOUBLE SALE po ba ginawa nila? Ano po dapat ko gawin? Gusto ko po kasi maliwanagan talaga eh. Pumunta po kasi ako HLURB DOUBLE SALE nga daw po pero pasok pa din po ba yun sa ganun kahit pa sinabe nila tinigil na ng naunang buyer yung paghuhulog???

Gusto ko kase mag-refund na lang for everything then ask them to pay me for dames, inconvenience, and stress that they caused us. Ano po kaya habol ko? May chance po ba ma-grant tong gusto kong mangyari?

Pa-advise naman po. Salamt po sa lahat.

Ask for the refund. You should be able to get it. If they don't give it to you, get a lawyer to prepare a demand letter. Camella pa naman yan so chances are i-ignore ka nila pag hindi ka nag-matigas sa kanila. Pero pag may kaso na isasampa sa kanila, makikipag-settle yan.

Wag mo na habulin ung damages kasi matatagalan ka lang. Baka mamuti mata mo kakahintay sa bagal ng legal system natin at maabala ka pa sa mga hearing etc.

Di po sya Camella sir. May friend lang po ako dun nagwowork sabe nya dapat mabigay agad title or else may problem talaga ako.

Ang problema ko lang po sa refund papano po yung mga nagastos ko. Yung receipts ng mga materials ko may iba na pong missing. Lalo na po sa Labor ko po wala naman po ako records nun baka baratin nila ako pagdating sa Construction Expenses ko. So wala pong chance na makasuhan talaga sila sa ginawa nila? Ang alam ko kasi illegal talaga ginawa nila sakin eh.

Ah di pala Camella. Meron naman chance pero mas mabuti talaga lawyer kausapin kasi mas alam nila yan. Makikipag-settle yan. Actually, kahit fiscal lang muna kausapin mo pwede rin. Punta ka lang sa Hall of Justice ng munisipyo nyo at maghanap ka ng fiscal dun.

Sige po Sir. Medyo magastos lang po yata ganun. hehehe. Ang hirap lang kasi parang ako pa po nagkakandarapa ng update sa kanila eh. Sa Sat pupunta daw sila may offer na naman sila malamang pabor lang sa kanila. They were offering me to choose another unit sila na daw gagawa ang problema ko lang pano ako makakasigurado na maayos gawa nila. Binigyan pa nila ako option na babalik daw gastos ko pili daw ako ibang unit then ako magpagawa kaso malabo naman ibalik lahat for sure.

Yung agent talaga may kasalan ng lahat ng ito. Nabentahan ako ng unit na ganto. Nasilaw dahil SPOT CASH. Masyado din kami nagtiwala.

Well, medyo magastos nga un pero ganun talaga eh. Kung madadaan naman sa mabuting usapan, dun mo na lang daanin. Kung ibabalik naman pala ung gastos mo, eh di sabihin mo ung ginastos mo. Basta hingi ka in writing nung mga ipapangako nila.

Ganun na nga po siguro. yung Ninang ko lang po kasi na nagpahiram sakin ng ibabayad ang nagagalit talaga dapat daw may damages dahil sa abala na ginawa at illegalities daw. Kaso kakatakot din maya kami pa mapasama lalo na pulitiko yata namamahala ng subdivision na to.

Sana lang may maganda silang offer sa Saturday. But I doubt it.

SOLAR po Sir sa may TRECE. Mga bare type unit lang po di gawa loob. Ewan ko ba bakit dito kami nakakuha daming problema.

^ Hire a very good lawyer whose specialize in realty cases.  You must ask for damages tulad ng sabi ng ninang mo, the lawyer can take care of it.

yes po that's really our plan but I don't have the capacity to pay for an atty's services. I tried to ask PAO regarding this matter. I just need an advice right now because I am not really sure if this falls in DOUBLE SALE.

Alam ko yan developer na yan...ginagamit pa nila si Pacman na kasosyo dyan kasi nga Solar.Bumili ako ng Lot dyan sa West governor sa trece... I also paid in cash......more that I year na hindi ba binibigay ang title ng lot na binili ko, nag follow up na yung sister ko sa office nila sa makati, rason wala daw yung tao na nag hahandle nun. Huling tawag ng sister ko sinabihan sila na ipa memedia sila, alam mo biglang tumatawag sa sister ko yung in charge sabi within 1 week daw makukuha na title pero may babayaran daw na fee. pero sa binarayaran ko dapat kasama na yung transfer sa name ko, nagbayad na lang ako. nakuha ko yung title ko.
 Alam mo kasi kaya hindi nila maibigay yung title kahit you paid in cash kasi lahat ng developer isinasanla yan sa bangko...hindi aaprobahan ng Pag ibig yan ng hindi nakasanla sa bangko, isa pa walang kakayahan ang halos lahat ng developer na idevelop yung property nila using their own money. Kung meron man magiging inhouse pag nagbenta sila sa kliyente. Ang mga ahente kasi wala iniisip yan kundi makapagbenta lang tapos pag nakuha na komisyon hindi ka na kilala, walang after sales support kang makukuha sa mga yan... karamihan dyan mangloloko at mga sinungaling. Hands on experience ko yan for the 5 properties I bought.
 
 The other way around tama yung developer: READ THIS:

 If Developer Failed to Issue TCT after payment
Kaukulang kaso laban sa isang sikat na developer na hindi naibigay sa tamang oras ang titulo ng aking lupa’t bahay na nabili sa kanilang subdivision? Kasi isang taon na nang ito ay aking mai-fully paid pero hanggang ngayon wala pa silang maibigay na title samantalang ‘yung iba kong mga kapitbahay after 6 months na ma-fully paid naibigay na agad sa kanila ‘yung title ng kanilang property.
 Dalawang bagay ang maaari mong gawin: Una, ang magsampa ng kaso laban sa developer dahil sa hindi natupad na kontrata sa pagitan ninyong dalawa at ikalawa, magsampa ng kasong specific performance o rescission.
Ayon sa Article 1191 ng ating Civil Code: “The power to rescind obligations is implied in reciprocal ones, in case one of the obligors should not comply with what is incumbent upon him. The injured party may choose between the fulfillment and the rescission of the obligation, with the payment of damages in either case. He may also seek rescission, even after he has chosen fulfillment, if the latter should become impossible. The court shall decree the rescission claimed, unless there be just cause authorizing the fixing of a pe¬riod. This is understood to be without prejudice to the rights of third persons who have acquired the thing, in accordance with Articles 1385 and 1388 and the Mortgage Law.”
Maaaring magsampa ng kaso laban sa developer dahil may kontrata na sa pagitan ninyong dalawa. Ayon sa batas, kapag may kontrata sa pagitan ng dalawang tao, kailangan nilang gawin ang mga obligasyon nila na nakasaad sa kontrata. Ang kontrata dito ay pagbebenta ng lupa’t bahay. Ang bumibili ng lupa’t bahay ay may obligasyon na bayaran kung magkano ito habang ang nagbenta naman ay may obligasyon na ibigay at ilipat ang titulo ng lupa’t bahay sa pinagbentahan niya. Kung isa sa kanila ay hindi tumupad sa kanilang obligasyon, ang naagrabyado ay maaaring ipawalang-bisa ang kontrata (rescission) o ipatupad ang kontrata (specific performance).
Maaari kang magsampa ng kasong specific performance o rescission laban sa developer. Kung specific performance ang isasampa mong kaso, iko-compel ng korte ang developer na ilipat ang titulo ng lupa’t bahay sa iyo. Kung rescission naman ang pipiliin mo, ipapawalang-bisa ng korte ang kontrata niyo at kailangang ibalik ng nagbenta ang perang nabayad mo na.

As for me Its much better to buy haus/lot through Pag-ibig sigurado ka na malilipat sa name mo ang title ang makukuha mo ito. Best things to do 1st buy through a reliable broker, then upon approval by Pag ibig. issue 24 PDC. if you have Cash pay after a year, pwede yun. shorten pa yung tatakbong interest sa property binili mo. suggestion ko lang yan. Kasi next time ganun gagawin ko thru pag ibig na lang.

To anyone buying a real estate property in our country.  Please, do not buy a property if you do not have any budget for legal expenses.  You will just put your money at risks.  Always make sure you have a legal fund to protect your rights.

Otherwise, it is just better to let your money grow in the bank even if earns less than you want rather than lose it in a property with a legal issue.
