Fully paid but still no Land Title after more than a year

hey guys,

Need your expert advice on this one. I bought a Lot from Sta. Lucia Realty, fully paid on 2009. They had me wait a year before they can process the Land Title. On April 2011, I paid them processing/titling fee ass well as Realty Tax.

Almost a year has passed and they say that the title is still being processed, and asked me to call in about 3 to 4 months.

My question is... is this normal? I need to have a house constructed but I cant do this without a Title. Why do I have to wait this long after paying them a ridiculous amount for processing fees?

Also can I sell them back this Lot? My mom gave me a portion of a lot (with title)  while I was waiting for this and I was thinking of just selling the lot from Sta. Lucia. What are my options?

it is not normal. the developer you mention has a lot of problems.  one reason is the practice of old developers to mortgage the entire project with the banks so maybe that's a real possibility why the title can't be transferred on time.

sana hindi ka umasa sa developer na mag transfer ng title mo. ikaw na sana mismo ang kumilos at nang hindi ka nanghuhula kung kailan nila matatapos ang proseso.

if the documents are all in order. transfer of title usually completed in 30 to 60 days.

Tama si sir bauer... 30 to 60 days lang kapag bayad at complete ang documents.

Check mo ang status ng documents mo, kung na saan stage na..from there... saka natin sundan.

Thanks guys, one of their personnel said that my title is delayed because they are processing titles "In Bulk". If I will demand that they just return what I paid them, do you think I have the law on my side on this?

Any legal actions I can throw against them. I was disappointed because they were a very prominent real estate company, and after what I experienced, I dont think I want to deal with them anymore.

Also, ask ko sila na ako na lang maglalakad ng title, sabi nila, not allowed daw, kasi sila ang kailangan mag process. Man, what a pain!

yung sa amin, mga 6 months ata inayos ng sta lucia, hinihintay kasi nilang me kasabay lakarin para siguro makatipid...lagi mo lang follow up, hingin mo yung contact number mismo nung nag aayos

ack! i also bought a land with sta. lucia ng suppose to pay it in full this month...
from the stories above, looks like i'll be facing the same issues you have... errrr

Naku..I could emphatize on your situation now...just a few months ago ganyan din ang situation namin. Bought a lot with Sta Lucia in Cash  and even paid the real estate agent ng 50K for  transfer, misc fee etc..sus..inabot din ng mahigit 1year. Imagine na lang stress namin nakailang followup ko sa main office nila bago naresolve. At ang hinayupak na agent :boxing: hindi na namin macontact after a few months nun nangungulit na kami kung kelan matransfer ang title. Ang naging pinanghawakan or peace of mind namin is according to Sta Lucia records the lot# is indeed on our name @their records with pending title transfer. Humingi lang ako ng printout ng computer. Hassle..Also discovered that ang hayup na agent na yun eh kumupit pa samin...The total cost of transfer is less 50% ng 50K na binayad namin. Well ayos lang sana naman yun If she had committed on her promises that she will all handle everything and title delivered to us.  Sa konti nya kinita..mas malaki di hamak ang nawala na potential sales nya kse pinagkalat ko na sa mga friends ko na wag na kukuha sa kanya. From my latest counts 4buyer na sana ang naging customer nya. 

Kaya payo ko sa mga PMT real estate agent wag naman po kayo sisira sa usapan..sa konting halaga mas di hamak na malaki ang mawawala senyo.  Sorry for the Rant :bahalaka:

Oh man, based on the stories of you guys, ganito pala talaga ang patakaran sa Sta. Lucia? good luck sa iyo angeljme hehe.

Thanks guys, at least your stories game me peace of mind that I will get the title... eventually.

well in fairness to SLI...not all of their project naman is ganun na natatagalan ang pagtransfer ng title. Depende po yan sa Project. Sometimes or most of their projects is meron pang ibang me ari ng raw land at parang co-owner ang SLI . Better ask from Head office if the proj is solely owned by SLI and ask infront how long will it take to  transferring of title. Mabilis lang kse sila sa Deeds of Sale.  Dont take the word of sales agents..hehehehe magaling lang sila sa sales talk.  (some of them)

at paiyakan pa ng dugo bago isoli ng sta lucia ang construction bond just in case you completed the construction of your house na ang lupa ay binenta nila. your lucky pag sinauli pa.

I'll take note on this developer, kasi affected din ang mga real customer-oriented agents/brokers kung ang developer naman ang problematic.

We had same problem with another developer before - fully paid na yung house and lot but no title given after that, and same reason also given that 'in bulk' ang title processing... don't believe kasi there are really other reasons for not transferring title ... what we did was to formally write HLURB Regional Director who has jurisdiction over the Project to let them intercede for the buyer, cc the developer of that letter... let all related documents be signed by all receiving parties (HLURB, developer, etc)... and give them deadlines or timetables for the developer to comply ... and see what will happen ... (in our case, it only took 2 weeks to produce the title! )...

processing in bulk by developers seems normal.
case in point, rockwell condos, this year by batch or bulk ang processing ng titles

another point is when processing msvs by for pagibig by a developer.
i notice like 7 days to follow up.

for both cases, if you do it personally or thru a broker, no doubt mabilis.
i did an msvs for a client with pagibig, it didnt took me 2hrs.
