Do I need to pay income tax, SSS, philhealth etc during probationary period?

Hello guys,

During my first company (way back 2 years ago), I have my basic salary and allowances deducted by income taxes and other government mandated benefits such as SSS, pagibig and philhealth.

However, recently I got a JO from another company. They said that during my 4 months probationary period, they will not file and I may not file those taxes... Gusto ko lang po i-verify if is this possible? Hindi kaya habulin ako ng BIR if nagkataon?

On my contract it states "Basic NET salary: xxxxxx".

I hope someone could answer me.

Sa pagkakaalam ko, kailangan ideduct sayo yang mga yan, (Tax, SSS, philhealth, pag-ibig). Yung tax pwede pang hindi kung may posibilidad naman na hindi ka maregular sa papasukan mong company. Ang magiging drawback lang nyan is kapag naregular ka, ang mangyayari is lalakihan yung magiging tax mo sa mga sususunod na buwan para mapunan yung mga buwan na hindi ka nakaltasan ng tax or sa end of year eh baka wala ka nang makuhang sweldo dahil pangbayad lang sa tax mo. Pero yung ibang deductibles like SSS, mandatory yang mga yan.

why there is a worrisome in paying taxes for small meager workers?.

if you don't pay tax, .. government will bring you in court, hire a prosecutor, put you in jail, feed you in jail, and the government will spend more to you.. :hihi:

..this compare to small amount of tax they will collect from small meager workers...

but wait.... seems that you are one of those big fish and have six digit salary :P .. and that is 'basic NET' (gaano kaya kalaki yung GROSS salary)

On my contract it states "Basic NET salary: xxxxxx".

(six digit salary) x 12 = 7 digits already which is a big amount to tax...

well, seems problem was happen 2 years back.

assuming you started in the company let's say September of that year and the accumulated salary till December of that year is less than the taxable income tax for a year, then you are relieve to pay the income tax. you should collect from your company any withholding tax they retain for that 4 months period.

if it happens that the accumulated total income of the year (January-December) is more than the taxable income for a year, you should declare your tax into your ITR and file.

your new JO (salary or allowance) still an income which is taxable if (again) the accumulated for total income is within taxable income.

it also depends on how the company accounts handle your 4 months probationary period. will they put in their accounting books as record other than staff payment? will not be declare as your salary income? will you received the salary without deduction of withholding tax?

Ang alam ko, basta government you need to pay PhilHealth and SSS.

Kung ayaw mong magka-problem sa SSS in the future, ituloy mo lang ang hulog. Yung PhilHealth naman, for your own good din naman yan.

What do you mean by probationary? Contractual ka ngayon? If so, yung government na dapat ang magde-deduct ng withholding tax sayo.

@neo, nope, for full time position po pero 4 months probi muna.

Yung set-up kasi ng first(current) employer ko when I was also under probi at that time (way back 2012) is every month meron na siyang DEDUCTIONS (SSS,Philhealth Pag-ibig) and Withholding tax na binabawas sa basic salary ko. Sila na rin nagfi-file at nagbabayad ng ITR ko for the  year after ma regular ako since I stayed there more than a year using the amount deducted every month....

Now, sa inaapplayan ko ngayon, the HR told me na during my probi, let's say 40k Basic NET salary, they will give it to me w/out deductions. Bale every month kuha ko nang buo yung 40k. It's up to me na lang daw if I'll pay my taxes.
Tapos if naregular ako after 4 months, I will still receive the same 'NET' amount and the company will now shoulder SSS, Philhealth, Pag-ibig and taxes.

Cguro if ever tanggapin ko yung offer, hindi na rin ako magbabayad ng tax during probi para makuha ko nang buo yung binigay nila :D Only SSS, pag-ibig and philhealth lang. Is this possible po?

Saka ang inaalala ko, how sure am I na hindi nga subject to tax yung earnings ko during probi pag magfile na ako/sila ng ITR?
Kasi if ever pag nagkaganun, almost same lang din yung tinatanggap ko na net from my current employer and cguro di ko na tanggapin yung offer.

And also, paano ba nade-determine ng BIR kung magkano ba dapat yung ibabayad na income tax per year ng employee?

the tax is annual and not really per month. They just take it every month para hindi nakakatakot na isang bagsakan/
So given na hindi ka nila binawasan, at the end of the year, if you total your gross annual income, then that should determine how much tax you are going to pay and should eventually deduct something at your december pay.
The only way for BIR to determine how much you should file is if they investigate your asset or company's record. Chances are very slim.
Linawin mo is SSS, pagibig are shouldered by your company since it should be half half. half contribution from you and half from your company. Pagibig for one can't be paid in advance or pay earlier to fill in.

All your earnings are subject to tax whether probi or not. If they don't want to deduct it on the first few months, at the end of the year babawasan dapat yun.

ibig bang sabihin, kahit na makuha ko yung 40k each month during probationary period,
still, at the end of year ay matataxan pa rin yun during those period?
Parang lokohan lang ata pag ganun?
