I am very sorry, I don't know if there is an existing topic for this.

I just wanted to ask on what should I do.

My cousin has a friend which is a condo agent, sabe nya pre selling daw and mura lang and the downpayment is installment. i was amaze because it has no downpayment, so i am very much interested to invest. I attended the open house and was able to fill up the forms but first sabe ko no commitment muna. She told me it was ok, until the following week when my cousin convinces me to get studio unit. I carefully think about it because according to the agent and to my cousin, after the reservation montly payment of the downpayment or what they call equity will start july so I think I really got a good deal. So I said yes, but I told to the agent i only have one problem because my money will to pay the reservation will only be available end of May which this coming May 30. So she said, since I am sure aabunuhan muna nya but I have to make sure I'll pay her. When I saw the computation the monthly payment will start May 30 of 2012 including the reservation within the month of may and I have to pay june of 2012 as well, I asked the agent about the july thing and she revert to me that the payment will really start may...and so now the checks are with her for 30 months and the check for reservation that I issue for May 30 for the reservation and the first monthly payment but dated May 30. I felt I was cheated and so I wanted to cancel the purchase, also I feel i was harrassed only that time when I am doing the check I hesitate to back out and now that everything seems clear I do really want to back out.

What should I do? the agent is now telling to still go for it and would be just fine to fail june 30 payment if i do not have the money to pay. I know she already invest her money on the reservation and I feel so shy to backout, but I feel like i was just force to take it. Please help me.. I need an expert for this problem.. I really wanted to investment but I feel like it's not yet my time and bka hinde ko mapangatawanan maiwan ko lang basta.

wag mo sya isipin,,, isipin mo yung kapakanan mo, agent yang kausap mo, its her job to persuade ang client..kht di kayang magbayad ng contract price ok lng sa kanila! basda makapag down ka!..

once na napilitan ka sa isang investment, meaning mas di mo nauunawaan ang pinapasok mo...wag mo unahin ang hiya, protect your money, wag ka makonsensya, kase ikaw ang mawawalan pag nagkataon...

 in the end mas mahirap magsisi sa hule na wala kanang magagawa.. get your check back & wag mag hesitate...

tel him na di ka pa decided, and more time to come out sa decision..

How can  I back out? ayaw nga po nun ahente.. aside from her sino po bang pwede ko kausapin. COmpany is Avida Intima... please help. gusto ko na po talga magbackout.

I think as an agent they can cancel the reservation without penalty. So, pwede ka parin umatras.I think kaya malakas loob nya umako para mag-abono ng reservation fee kasi hindi naman sya naglabas talaga ng pera. I'm not sure about how the process is pero I think ganun ang naging strategy nya.

i did before,, nag back out ako,, and di kanmn nag sign ng contract,,, and nabawi ko noon ang reservation ko.....go & check the website itself and contackin mo agad ang management..

May pinirmahan ka bang reservation agreement? Is the reservatin fee partially or fully refundable?

But 1st things 1st. Have all issued checks stop payment with your bank. Just in case the agent won't return those postdated checks. Hindi rin Nila maenencash or madeposit man Hindi Mapondohan mga cheques.

pagmatigas pa rin ulo ng agent. Tanungin mo kung license real estate broker siya. Kapag hindi, mag file ka kamo ng kaso for misrepresentation.

kapag oo sagot nya, mag file ka kamo ng complaint sa professional regulation commission against her/him.

mabilis pa sa alas kwatro, susunod yan sa gusto mo.

Don't be shy to back out, mas nakakahiya na makiusap or magmakaawa na bigyan ka ng palugit ng management sa pagbayad at pag pondo sa mga post dated cheque mo tska  pag nagkabaon baon ka sa utang kakabayad sa amortization na yun or worse mapunta sa wala yung binabayad mo dahil hindi mo na kayang iprovide yung mga susunod na payments.

If it was me in your shoes I wouldn't have let the agent do that in the first place.

I am an agent and I won't do that unless it was family (even then with a contract between the both of us). Yes, as an agent also we do some persuading and medyo pacute ng konti. I pride myself of being professional in all my jobs even in photography and selling real estate. The client should be persuaded through the quality of the project and the right timing when he has funds. Kung gusto naman magagawan ng paraan. Kung ayaw, walang pera or panget project talaga or is not into condos or maybe not buying now. In any case, i do not burn bridges. In fact, I welcome friendships beyond our transactions kahit hindi na bibili. Walang pilitan. hihihi

I'm not saying you guys are doing this but please don't shrug off flyering agents. Dati I don't even smile and just ignore them. Now that I am here, I atleast smile and tell them to move out of my way (JOKE)

In any case, if you value friendships, lalung mas importante yung may contract in my opinion. Kung na-ooffend ang friend mo because of that, kindly explain to her your side. And kung ayaw pa rin, wala siyang balak bayaran ka pa.

Back to your case. Why dont you just pay her the amount na inabonohan niya?

Reservation fees are only good for 30days and usually non-refundable in case you decide not to continue but it will be deducted from the DP if you proceed with the transaction. Your first payment of DP is due within 30days of your reservation date so as not to forfeit your reservation fee.

Sometimes, no DP is enticing. But, check also how much you can save if you decide to pay your DP in cash. The higher your DP, the higher is the %discount.

if you requested na sya muna magbayad then abunuhan mo, nakakahiya yun.
pero kung sya nagoffer magbayad, iba na un. somehow na persuade ka nya.

regarding sa pag backout, automatic cancel account pag d mo tinuloy ang DP at non-refundable yan.

i understand friend ng pinsan mo yun kya may linkage somehow na nakakahiya.
kausapin mo na rin ung pinsan mo about it. nagconvince din ksi ang cousin mo to get the studio.
either magaabot somehow ng small amount of referral fee ung agent sa pinsan or friendship referral lang.

but since May pa pala to, marami nang nangyari.

Pay her back what she paid pero alamin mo magkano ang incentive nakuha niya pra i less mo nalang.
