This is a case of kidnapping at wala ng iba. Ang tanong did anyone ask for ransom from the family? Kahit kusa pang sumama ang victim the mere fact that he was deceived for a job offering can already merit a case for kidnapping since he was deny of his freedom to contact his family. I know our lawyers here can give a better opinion as to the legal implications regarding this issue.

So what is the purpose of this thread? To know if he'll accept the job given the working conditions. He can accept the job offering if that's the only job available for him, though I know there are better jobs waiting for him someplace else. Advise your friend to overcome his dependence to other people, diba gusto na niya maging independent? He should find a job not so much relying for those he know to find one for him. I think that's the downside of being too dependent on his family's biz, medyo humina na siya pagdating sa diskarte sa buhay since he's been spoonfed all his life.

The crime of kidnapping/serious illegal detention is punished under Articles 267 of the Revised Penal Code, as amended. The hostage-taker is properly charged with kidnapping or serious illegal detention. Article 267 reads:

Art. 267. Kidnapping and serious illegal detention. — Any private individual who shall kidnap or detain another, or in any other manner deprive him of his liberty, shall suffer the penalty of reclusion perpetua to death:

1. If the kidnapping or detention shall have lasted more than three days.

2. If it shall have been committed simulating public authority.

3. If any serious physical injuries shall have been inflicted upon the person kidnapped or detained, or if threats to kill him shall have been made.

4. If the person kidnapped or detained shall be a minor, except when the accused is any of the parents, female, or a public officer.

The penalty shall be death where the kidnapping or detention was committed for the purpose of extorting ransom from the victim or any other person, even if none of the circumstances above-mentioned were present in the commission of the offense.

When the victim is killed or dies as a consequence of the detention or is raped, or is subjected to torture or dehumanizing acts, the maximum penalty shall be imposed.

What are the elements of kidnapping or serious illegal detention?

The elements of kidnapping or serious illegal detention are:

1. That the offender is a private individual.

2. That he kidnaps or detains another, or in any other manner deprives the latter of his liberty.

3. That the act of detention or kidnapping must be illegal.

4. That in the commission of the offense, any of the following circumstances is present: (a) That the kidnapping or detention lasts for more than five (5) days; or (b) That it committed simulating public authority; or (c) That any serious physical injuries are inflicted upon the person kidnapped or detained or threats to kill him are made; or (d) That the person kidnapped or detained is a minor, female, or a public officer.

What if there’s kidnapping or detention but  none of the circumstances in Article 267 is present?

If any private individual kidnaps or detains another, or in any other manner deprive him of his liberty, but without any of the four circumstances mentioned in Article 267, the crime is slight illegal detention. This is covered under Article 268 of the Revised Penal Code.

Now that I've got the facts straight. I don't think it was a planned kidnapping. First of all their kuyas are friends, so if something bad happened or money is actually demanded they can easily be implicated or becomes a prime suspect, since bago cguro sumama si rich kid he'll at least tell his family where He is going.

Now bakit nasapak si malatuba when asking his kuya " ano Ito kidnap?" nasapak siya dahil sa stupid question or being tactless on his remarks. Hindi na tinuloy pag-offer ng job for the following reasons:

Baka nga makasuhan pa si kuya ng kidnapping since his younger brother mentioned the word at napaisip-isip siya

hesitant or doubtful rich kid can handle the working environment.

Tried to offer a job knowing rich kid won't take just to show their willingness to help.

basta hindi natuloy sumama kasi nga nagtanong kung kidnap, at hindi ayaw bangitin kung saan yung place.

uulitin ko kaya ako nagtanong kasi in between days nung offer at nung day nasapak si malatuba... it was those days that rich kid was asking questions kung normal lang ba yung matutulog ka sa papag at ibibigay mo ang celphone.

kaya classmate ni malatuba kasi that time nag-aaral pa rin si malatuba sa college kasi inuna pagbubulakbol nung high school at mismong college.

ok naman. bale nagtanong lang ako kung may kapareho kami ng iniisip. which is possbible na maging kindap yung pag-invite sa work. pero yun nga, still yung kups (sorry for the word, pero yung talaga bagay na tawag sa kanya) still has no job. ilang taon ng nakalipas yang insidente.

very interesting naman po niyan. first time ko po makabasa ng ganyang situation. thanks for sharing SirZap. On a legal standpoint, mahirap iargue that it was kidnapping. but first po, tama po ba na hindi natuloy? so it was a mere "attempt". but even in legal contemplation, hindi siya masasabi na nasa attempted stage.

pero napakainteresting po assuming that rich kid took the offer. so assuming na ganun na nga ang nangyari, the key element to the crime of kidnapping or illegal detention, for that matter, is deprivation of liberty. if he is detained for more than 3 days, kidnapping. less than that is illegal detention only.

in my opinion po: general rule, if any of the four elements were present-kidnapping. kapag wala/kulang yung element sa itaas-illegal detention. exception: kidnapping parin basta may extortion ng money, kahat wala yung apat na elements. as long as dineprive po siya ng liberty without justifiable cause.
