How to register a real estate brokerage company?

very Simple ! register your real estate com. to SEC, BIR, DTI, local goverment and ofcourse you must have a real estate brokers license from PRC itself only..

Hi Argel, hope you post your steps since you already finished your registration.

Anyway, one benefit I just discovered of getting brokers under the PRC is you don't need a sole proprietorship anymore. Yup, just register with the BIR as a professional and you can already get official  receipts under your name.

The sole proprietorship was a requirement during the DTI days. You can still register a sole proprietorship but I don't know the benefits of doing that. If you just register with the BIR as a professional, you don't need to get the local gov't permits.

If you want to become a licensed broker, take a CRESR (CRESAR) seminar. This is the required seminar for all aspiring brokers before taking the exam. This seminar is usually conducted by local broker boards such as PAREB and REBAP. You can also search for Urban Institute of Real Estate and Cesar Santos Real Estate Academy.

If you want to do real estate transaction than it needs to have licence of real estate agent and after that we can make brokerage on property.
Important for Property Management to have a bit of common sense.

I'm not Filipino, so i'm not very familiar with tax laws and other requirements but I was wondering if the following would be possible (and legal, no tax evasion etc.):

Person A invests a sum of money into a company set up by person B.
This money is used by the company of person B to buy an apartment property.
Because persons A & B have a notarized agreement that B must pay back the investment (which is of the same value as the apartment) and that the apartment serves as a collateral there is no real financial risk for person A.

The company will then rent out the apartment to a renter/lessee (it doesn't hold office there). From the rent money VAT is paid to BIR, the rest of the money is used to pay of the investor (person A).

Would this construction make the purchase of the apartment exempt from VAT?

As far as I know, VAT is only charged to end-customers which the company would not be. And because VAT is paid on the collected rent, there is not evasion of tax.

At the same time it becomes cheaper to acquire the property because there would be not VAT paid at that time. (which is 10% of the total value I believe).

Could any of you comment on this plan? Would there be any specific requirements for the company? Does the company have to be a licensed real estate company, or maybe just the person operating it?

First You Should be a license Real Estate Broker. if not review, seminar and pass the Real Estate Brokers Exam but remember you should have at lease 2 sems in college to be qualified.

Second: Secure a DTI business permit since its a single proprietor.
You have to secure your TAX Identification Number and Printed Receipt.

Third: Secure a City Business Permit. Where, at what place would you want to practice your Business.

So i can make use of my EXISTING TIN # and simply register as an individual real estate broker?  Aside from my PRC id, is there anything else that I should submit during the registration?  How long does it take for me to get the BIR cert?

So if i don't register a trade name (single prop), confirmed po ba that I don't need to secure the usual govt.permits?  

Saan din po magpapagawa ng receipts?  

Sorry for bombarding you with so many questions. I'm very new in the industry and I am in need of a mentor.
