Thank you Suntzu and Bauer. Looks like the best route is to get the services of a lawyer. Any idea kung magkano ang usual rate ng attorney for such cases? Hope to get more feedback especially from those who have first hand experience.

my husband is abroad in UAE.  we plan to buy a lot here in the philippines.  a lawyer told me that my husband should get an SPA giving consent for me to buy said property.  and this SPA should be authenticated in the philippine embassy.  will be using money from our joint account and partly from my personal account.  and the transferring of title to our name, how should i go about it?

@selyado,

actually, you do not need an SPA from your husband.  Simply execute a deed of sale, you as the buyer (signatory to the transaction).  just mentioned in the deed of sale that you are married to your husband.

sa transfer of title naman, babanggitin rin doon ang "married to" in effect kayong dalawa ang may ari.

pag kayo ng husband mo ang magbebenta, diyan, sigurado kailangan ng SPA.

a lawyer friend kasi told me this:  "Requirement kasi na pag married ka at galing sa conjugal funds yung pambili mo, both spouses should sign.  Otherwise, the sale can be invalidated to the extent of 50%   Baka magkaproblema lang kung ikaw lang ang pipirma at sa iyo ipapangalan yung tct."

at heto pa, the land being sold is owned by a couple who is abroad.  si husband has an SPA authorizing his parents to sell the property.  si lawyer friend again told me na dapat both the husband and wife should have SPA to authorize the sale.  and this SPA should be authenticated in the embassy/consulate since they are out of the country.  kaya ayun, mukhang made delay yung pagbili ng property.

the amilyar hasn't been paid since 2006 pero babayaran naman daw nila yun once i give my reservation/earnest money. 

wala bang shortcut dito sa ganitong transaction?  sobrang risky ba itong sale na ito?

@selyado, when it comes to real estate and other extremely large purchases, you should always practice due diligence so that you don't end up making expensive mistakes. You said you already consulted a lawyer about the property you want to buy. It's risky to ignore what the lawyer said and to try to shortcut the process. Baka sa kaka-shortcut mo, ikaw rin magsisi sa huli.

If there are too many complications regarding the ownership of the property, perhaps it isn't a good buy after all.

Your lawyer is correct on the said comment.

Di naman malaki ang risk kasi humihingi ka ng advice sa lawyer BEFORE the purchase of the lot.  Ganyan talaga pagbumibili ng property, maraming hassles, DONT ATTEMPT ANY SHORT CUT.  kung nag shopping ka nga ng damit, nanghihinayang ka kapag nagkamali, property purchase pa kaya?

di naman siguro problema ito unless may marriage problem later at magkaroon ng settlement sa mga property nyo. not sure though! nung bumili ako ng foreclosed property sa bank, they give me an option what to put in title "spouses (both husband and wife name)" or "married to".

eto kailangang-kailangan talaga...or else voidable ang contract. conjugal property kasi, kaya both should have consent.

ganyan talaga pag nagbili ng property daming aasikasuhin. mas lalo na pag ililipat na sa pangaln nyo ang title.

Kapag inaayos ang papeles para mailipat sa name yung title ang daming mangongotong, mga buhaya na nakaabang para manglapa, dya sa Cavite garapal ang mga examiner dyan. Wala sa upisina lagi tapos sa text lang idinadaan. Kaya kung nakatira ka malayo sa cavite kawawa ka sa kanila. :harhar:

am i now obligated to buy this corner lot?  gusto na kasi ako papirmahin ng earnest money deposit receipt agreement nung broker.  i told her na my lawyer said that i should not pay nor sign any documents until we get the sellers' SPA.  meron pa kasi akong isang lote na tinitignan na talagang mas gusto ko.  malabo din kausap ang may ari nitong lote na ito, gusto ako sumagot ng capital gains tax, ng extra judicial gastos.  but now someone is trying to mediate para magkasundo kami nitong seller na ito.  can i still say no dito sa broker na nag o offer nung corner lot?

@selyado, You are the buyer. Sila ang may kailangan sa yo, not the other way around. Don't feel pressured to put money down especially since you're not even sure which property you want to buy yet.

If there is still an unsettled issue regarding the ownership of the property, and the broker or whoever keeps asking you to pay a "earnest money deposit" or "reservation fee" or whatever, for me that is a BIG red flag.

don't sign anything or part with any money, unless you are 100% na yun talaga ang property na gusto mo, at higit sa lahat, sigurado kang nasa maayos lahat ng papeles. if there are too many issues, It might be wiser to just find another property, yung walang masyadong extraordinary hassle (because as it is, madami na ngang requirements at proseso ang involved jan). wag na maghanap ng additional sakit ng ulo at gastos. kahit pa sabihing ‘matinong kausap’ yang mga sellers mo, its most prudent to protect yourself from any possible inconvenience or legal problems in the future. As we always say here at PMT… Caveat Emptor <buyer beware>!

I agree. Not because it’s stated in the title that X “married to” doesn’t automatically mean they both own it, as compared to the statement “Sps (spouses) X and Y, buyers etc”.

What To Ask Your Agent Before Buying a Property

In 2009, an estimated 85 percent of cases being filed with the Housing and Land Use Regulatory Board legal office involved refunds of installment payments on real estate properties. The refunds of installment payments included subdivision and condominium developments in Metro Manila.

What may have become an all-too-familiar scenario in the HLURB halls have been complainants filing cases against developers who didn’t complete their projects, despite receiving payments even during the pre-selling phase.

HLURB legal officer Mike Denava lamented that prospective buyers should oblige their sales agents (even of reputable developers) to show documents pertaining to the project and the developer before giving the downpayment.

Aside from that, Denava and fellow officers from HLURB advise the following, before buyers commit to pay for properties:

1 Do an honest-to-goodness reality check. Will your resources allow you to maintain a monthly amortization? Look into your source of income, whether you can afford to pay equity and the monthly installments.

“We have seen many cases of overseas workers who bought preselling properties but could no longer maintain the monthly amortization even before the house and lot or condominium was turned over because their contracts abroad were not renewed,” said Denava.

2 Check if the broker/agent is registered with the HLURB and especially ensure that the property being eyed has not been sold to other buyers.

3 Make sure that the developer has a License to Sell for the particular project. Ask the seller or broker/agent of the developer if the project is registered and has a license to sell issued by the HLURB. This can be verified in the HLURB website (www.hlurb.gov.ph).

Runel B. Taningco of HLURB’s Information and Communications Technology Division advised prospective buyers to go over the HLURB list of projects that have failed to show any license to sell and have violations on record. He revealed that most of the entries on the list involved preselling projects.

For the list of the projects in Metro Manila and Rizal that have cease and desist orders, check out http://hlurb.gov.ph/ wp-content/uploads/home/ project%20with%20CDO/ CDOENCR.htm. For nationwide projects outside of Metro Manila and Rizal, check with the HLURB regional operations at http://hlurb.gov.ph/about-us/.

“We try to put everything in the website guidelines. We try to update as frequently as possible. Preselling (violations) should be reported to us. Without reports/complaints, we cannot issue CDOs (cease and desist orders). (Our) regional offices maintain monitoring groups: status of developments of projects that were issued licenses to sell,” explained Taningco.

He added that there have been incidents where buyers did verify preselling projects at HLURB, but only after they had already been paying for the property for more than a year.

Buyers are also advised to read Presidential Decree 957, or the Subdivision and Condominium Buyer’s Protective Decree (as amended by PD 1216). The decree involves regulating the sale of subdivision lots and condominiums, and provides penalties for violations.

An Inquirer Property reader once commented that “no pre-selling should be the rule, unless the project is at least 80 percent complete.” The reader went on to say that “as it is, the delay in the delivery of the units and the documentary proof of ownership is the common practice by most developers.”

4 Personally visit the subdivision/condominium, where the house and lot or condo unit to be purchased is located. Check if the materials of the house or condo unit conform with the development standards and approved construction specifications submitted to HLURB. Check also who would pay the cost of the water and electric meters, the subdivision perimeter fence, and so on. Check also who would eventually operate the subdivision/ condominium’s water system.

5 If the project has a License to Sell, you may already enter into a contract to sell with the owner/developer. However, there are things which must be checked before signing the contract:

• The date of completion of the project as indicated in the License to Sell;

• If the property is mortgaged from the HLURB;

• The facilities and amenities represented in the advertisement flyers/brochures are in accordance with the approved subdivision and condominium plan on file with HLURB.

6 Before signing the Contract to Sell:

• Don’t sign any blank form of the CTS.

• Read thoroughly all the contents of the CTS, especially the terms and conditions in fine print.

• Secure a copy of the CTS and all other documents that you signed.

• Make sure that the CTS would be registered by the owner/developer to the Register of Deeds.

• Pay directly to the owner/developer or the marketing agent authorized by said owner/developer;

• Ask official receipts on all payments for your file.

okay, may SPA na yung mag asawang seller.  the broker said kaliwaan na daw.  they'll pay the amilyar plus the capital gains tax while i hold on to the title.  safe na ba yung ganung usapan?  oh, may pirmahan na ng deed of sale na involved din.  i was telling the broker na dapat yata mag hold ako ng 6% for the capital gains tax.  tapos saka ako full payment kapag tapos na nila bayaran capital gains tax.  ayaw pumayag ng broker.  bakit?

Capital Gain Tax is normally paid during the transfer of title from one owner to the other. Kung binigay nila sa iyo ang title (at sa seller pa nakapangalan), that means ikaw ang magpapalipat ng title sa pangalan mo....at dahil ikaw ang nag process ng transfer... ikaw rin siguro ang mag babayad ng lahat ng processing fees (including capital gain tax). Options:...
a) bayaran mo muna and then claim it from the seller...
b) deduct certain amount/percentage from the total cost of the property to pay the capital gains.
c) your option that you stated above (pay in full once the capital tax is paid)... pero this would mean the transfer of title to your name is already being processed.

I would suggest to consult a lawyer. Kasi dapat naka indicate sa conditional deed of sale kung sino ang magbayad ng capital gains at real estate taxes.

Kahit pa kaliwaan you still need to have a contract which clearly states who should pay what. This will cover your concerns.

Do not rush!

Like other guys said in the thread... ingat sa mga assessor sa Cavite. I just found this out last year... but too late.

what about double deed of sale?  i am not comfortable with declaring just the zonal value of the lot.  the broker said it would benefit both the seller and the buyer.  but lawyer said there's tax evasion to watch out for.  would you believe di pa rin kami nagkakasara nitong seller ng corner lot na ito.  gusto kasi mababa lang ang bayaran nilang capital gains tax.
